Oklahoma Supreme Court has found Title 85A Section 57 to be unconstitutional

The Oklahoma Supreme Court has found Title 85A Section 57 to be unconstitutional.  This section allowed for the forfeiture of all benefits if the injured worker missed two or more scheduled appointments for treatment without a valid excuse.  Transportation was specifically mentioned as an invalid excuse.  The Supreme Court determined that this provision returned “fault” to the no-fault workers’ compensation system ruling the entire section unconstitutional.
