McAnany, Van Cleave & Phillips represents banks and other lenders in the loan process from start to finish.  We assist clients by drafting loan policies and procedures along with other internal guidelines. Our attorneys help clients in loan transactions by participating in the negotiation and drafting of loan commitments and loan documents of all types. We help lender-clients identify their options and alternatives when borrowers' situations warrant attention. Our attorneys assist lenders by collecting delinquent loans and recovering and disposing of collateral. We represent clients in mortgage foreclosure actions, replevins, actions to foreclose security interests, nonjudicial real estate foreclosure matters, bankruptcies and many other matters to enforce the rights of lender clients. The firm's attorneys also represent bank holding companies concerning their governance, regulatory matters and shareholder buyouts.

Securities and Investments

We assist clients in regulatory matters and help establish procedures to ensure compliance with applicable laws and regulations. Our attorneys have successfully defended investment advisors and broker clients  in the securities industry against claims brought by investors. We have drafted successful motions for summary judgment, disposing of claims of securities fraud, Rule 10b-5 violations, and punitive damages and have successfully defended clients in arbitration matters concerning investor complaints.

Bankruptcy

MVP represents lenders in the federal bankruptcy courts and protects their rights through actions including:

  • Obtaining relief from the automatic stay and adequate protection orders
  • Objecting to and negotiating confirmation of bankruptcy plans
  • Structuring cash collateral orders
  • Defending preference actions and adversary proceedings
  • Representing unsecured creditors' committees

Fiduciary Duties

We are a leader in advising clients concerning the law of fiduciary duties of bank officers and directors, broker-dealers, investment advisors, and insurance professionals. Acquisitions and Leasing
